Charges pending in at least the Winnipeg Police HQ and Caspian Construction Corruption Scandals – is there more

Finally some more news of this investigation progressing towards charges. It is worth while for the RCMP Corporate Crimes unit to do a thorough job to strengthen the Crown’s case.

The Mounties would not reveal who could be facing charges, but search warrants and production orders obtained by CBC News have named contractor Armik Babakhanians of Caspian Construction, office manager Pam Anderson, ex-City of Winnipeg CAO Phil Sheegl, consultants Peter Chang and Patrick Dubuc.

All were suspected in various criminal offences ranging from fraud to breach of trust in court documents filed throughout the investigation.

Strange how Katz and Shindico not named this time but were previously. There is links to previous articles where they were.

There is also information to indicate investigations are also needed regarding serious allegations of fraud or breach of trust involving former WPS officer and now ACS employee Jon (John) Butcher, ACS / Lockheed Martin / Xerox = / Conduent Photo Enforcement, present or former public officials including former Mayer Sam Katz, CAO Phil Sheegl, BBB, IGF Field Construction and repairs, old stadium site redevelopment plan (loss of promised property taxes …), firehall land swaps,  Shindico, Parker and Hydro Land deals involving BRT Phase 1 and 2, Gem, Waverly underpass, other developers and at least review other P3 contracts.

Only once these dealt with properly will many of the doubts the public has about proper justice be removed and much of the public’s trust and confidence restored.

The RCMP Corp Crimes unit has said is under staffed and funded so these are on hold or not started (yet?).  Contact your MP and the Federal Justice Minister to ask my this important unit is forced to operate like this when the Liberals said they wanted to help restore public confidence during the last election, after the Senate scandal and other scandals.

I also found this related post involving at least the firehall land swaps but do your research on the author and sources to decide how much weight to give this but some of it already confirmed by by CBC via documents the RCMP released from the investigation seizures and affidavits. These allegations not proven in Court yet.

Read on to learn what you can do to help make sure charges are laid if appropriate and justice is served. Including what is needed after RCMP / Crown lay charges.

Myself and many others in at least Winnipeg and Manitoba are more than disgusted with the state of OUR politics, enforcement of our laws equally, weakness in or enforcement of current transparency and accountability related legislation and policies; police and justice.

We have been waiting for this investigation to produce meaningful charges, fair trials and convictions for those responsible for deliberately defrauding the public of hundreds of thousands of dollars and collectively Millions plus all the negative spin off effects this has been having on society and the economy.

There is many including those well informed that still have doubts justice will be served in these and related cases. I was thinking this investigation was taking awhile but am glad the RCMP have taken their time to be so thorough as it will strengthen the Crown’s case.

It is crutial that the Crown and higher Court do their part to deal with this properly as well to make sure those responsible are held properly accountable and there is restitution for these crimes.

Only then will this be a proper deterrent and help start the process of restoring public trust and confidence.

** I suggest at least Manitobans or any Canadians concerned about these investigations or corruption and public trust in general to contact the Deputy Premier; Minister of Justice and Attorney General of Manitoba (Heather Stephanson)

As AG she has supervisory powers over prosecutions, including those mounted by the Crown Prosecution Service.

Remind her of her responsibilities and ask how she plans to handle these important matters. Find some suggestions below but put it in your own words.

Never under estimate the influence an informed, united and collective public can have on their elected and appointed officials even in between elections.

Consider cc. Premier Pallister who its told runs a tight ship. For good measure consider including the Minister of Finance as I am sure they would lie to see the City (money pit) recover some of these funds, Bowman and your MLA and Councillor.

The Crown needs to take the information and evidence from the RCMP and charge those involved appropriately. Even the small amount of info made public indicate there is enough evidence to warrant charges and trials.

Fair Trials

Once this done Justice’s will be assigned to hearings and later to the trials.

There has been some Justices appointed in at least MB that had strong ties in politics or were investigated for conflict of interest and several questionable decisions where allegations of bias. Some are still under investigation by the judiciary council or decisions being appealed.

Judiciary independence is a fundamental of our Constitution and vital for our democracy to function effectively and efficiently.

If there is any question of bias for any Justice assigned during these high profile corruption cases involving past or present public officials the Crown needs to request another Justice. There is formal provisions for this in our laws or Court Directives and a rarely used process if needed.

Sentencing and Restitution

Once a fair trial proceeds and if there is convictions there needs to be harsh enough sentencing to act as a proper deterrent. The Crown should request (and Justice / Court order) appropriate sentencing plus restitution.

These criminals need to be ordered to pay back the public funds they obtained fraudulently or via breach of trust plus damages including but not limited to interest from debt taken out to cover the over charging and illegitimate overruns, a proportionate amount of the financial costs from delays related to these projects running out of money earlier than they should have if legit etc….

For convictions of Breach of Trust minimum sentence is 5 years and up to 14 yrs in prison. For restitution if these criminals have already spent their spoils then the Crown needs to request or Justice / Court order forfeiture of property from proceeds of crime or a fine in the amount of the property if they cannot be made subject to an order. e.g. Property(s) in Arizona or …

If this still not enough our laws should permit their pensions and other investments be considered. If not we must ask our MP’s and Federal Ag to reintroduce Bill C518 (search for this on my blog).

If they fail to pay the fines they are incarcerated longer.

Even when prison time served they need to be barred by the Court from any public service or public contracts for life. If needed ask as above for legislation.

What next
